General Terms of Sale

Article 1. Purpose and scope

These terms govern the use of the Orbit services, published by Marwane TASSA, sole proprietor (entrepreneur individuel) trading as “lafabops”, 60 rue François Ier, 75008 Paris. SIRET 500 906 573 00042, RCS Paris 500 906 573, VAT FR96 500 906 573.

They apply to every purchase of credits and every deliverable download. The service is reserved for professionals. By creating an account, the customer declares that they act for professional purposes. The service is not offered to consumers.

Article 2. Account access

The customer signs in to their account at compte.aix.lafabops.fr. They provide accurate information and keep it up to date.

They keep their login credentials confidential. Any action taken from their account is deemed to have been taken by them.

Article 3. Services

Orbit is an online services platform for AVEVA E3D software. The customer uploads a 3D model file. They view the result in 3D free of charge, along with a report. This report lists what will be created and what will not.

To download the deliverable, the customer buys credits. The deliverable includes the PML macros that create the elements in E3D, a master macro, a README and an Excel report.

The services currently open are Orbit Import and Orbit BOM. The upcoming services (Orbit Isos, Orbit Plans and Orbit AI) are governed by the same terms as soon as they open.

Article 4. Pricing and payment

The visualization and the report are free of charge.

The price is calculated from the number of elements in the file. It is displayed before any payment. Only what is delivered is charged: elements that the report shows as not created are not charged.

Prices are stated and paid in US dollars (USD), excluding VAT. VAT is added where applicable.

Payment is made by PayPal or by bank card, through the payment provider PayPal. lafabops does not store card numbers.

Article 5. Credits

Credits are used to download deliverables. They are valid for 12 months from the date of purchase. After that period, they expire and can no longer be used.

Article 6. No refunds

No refund is granted, whether for purchased credits or for expired or unused credits. Before any purchase, the customer has the free visualization and report to assess the result.

Article 7. Deliverables and limitation of liability

Deliverables are provided as is. The customer checks them in E3D before any use.

The liability of lafabops is limited to the amount paid for the file concerned, except in cases of gross negligence (faute lourde) or fraud (dol).

Article 8. Customer files

• Uploaded files are confidential. lafabops does not reuse them and does not share them with any third party.
• Before payment, retention of uploaded files is not guaranteed: lafabops may delete them at any time.
• Once payment has been made, the purchased deliverable remains available for download for 30 days from the date of payment, and is then deleted. It is the customer’s responsibility to download and keep it during this period.
• The customer can permanently delete their files and deliverables from their account area.

The processing of personal data is described in the privacy policy.

Article 9. Ownership

The customer remains the owner of their files and of the deliverables produced from them. The Orbit service, its site and its tools remain the property of lafabops.

Article 10. Service availability

The service is provided on a best-efforts basis. lafabops does not guarantee continuous access and may interrupt it, in particular for maintenance.

Article 11. Changes to these terms

lafabops may amend these terms for the future. The date of the last update appears at the top of the page. The terms that apply to a purchase are those in force on the date of that purchase.

Article 12. Governing law and disputes

These terms are governed by French law. In the event of a dispute, the parties first seek an amicable solution by writing to tassa.marwane@lafabops.fr. Failing that, the courts of Paris have jurisdiction.
